Legal Framework: BIM Obligation in Germany

As in other European countries (e.g., Austria), guidelines on the use of BIM have been published in Germany over an extended period, gradually moving toward a full obligation. In 2021, the Federal Ministry of the Interior, Building and Community (BMI) published the “BIM Master Plan for Federal Buildings”. This document outlines how a mandatory use of BIM will be introduced in Germany in a phased manner (three staggered stages).
Additional guidance is provided by the “Implementation Strategy for BIM in Federal Buildings” (2023, BMWSB).

 

Phased Introduction of the BIM Obligation

    Phase I (since 2022):

  • Introduction to the collaborative working method BIM
  • Focus on requirements planning, design phase, handover, and commissioning
  • Applies to all federal construction projects, regardless of project size

  Phase II (since 2023):

  • Expansion to include tendering, awarding, and construction execution
  • Model-based derivation of quantities, costs, and specifications
  • Initially for projects from €50 million; from 2025, for projects starting at €500,000

  Phase III (from 2025):

  • Digitization of additional process steps such as model-based scheduling and logistics planning
  • Initially for very large construction projects (from €50 million)
  • From 2027, also for approval processes of all projects starting at €500,000

 

Conclusion:

Government requirements for BIM models are becoming increasingly strict (models must contain more information), and BIM is being made mandatory for a growing number of construction projects (from 2027, for approval processes of all projects starting at €500,000).
